Mr. Ebbeler,
I am a 40 year resident of Riverdale Park. I just read your resolution
regarding Jey's Auto.
I also read the concerns of Resident Holmes and he makes some good points
about environmental issues.
My question is in regard to your resolution when you say "Whereas the
property has deteriorated to the extent.....and so on.
If my property as a resident deteriorates to such an extent as to be a
health hazard etc. then would not the town issue me code violations and step in
and repair the property and put a lien on it for the work they did?
Wouldn't it be the same case for Jey's Auto? Why does Jey's Auto get away
with "numerous code violations that are not addressed and remedied"?
Although I like the idea of a park at the entrance to our town, I don't
like the idea of buying a derelict property because the owner won't fix it or
remedy code violations. This could be a precedent for other owners with
deteriorated properties to expect the town to buy their properties as well.
I would like to see more investigation into this resolution regarding
environmental issues and also taking into consideration the many code violations
and deducting them from the fair market value price if you do indeed vote
to go through with this proposal.

Although this resolution was passed in the legislative meeting lasted past
midnight I feel it is important to address your question. The property is
in severe non-compliance with Town and County Code and the owner has not
addressed our concerns, nor given any indication that this will change. As
I am sure you can agree based upon many of your earlier posts encouraging
the town to protect, if not expand our environmental heritage, this property
would serve the town better if we bulldozed the building and had a
park/green space vs. continuing to turn a blind eye to one of the most obvious
commercial eyesores on Route 1 in Riverdale Park.
As Chair of the Economic Development Committee it is my obligation to
address situations like this as well as the vacant Town Center and find ways
forward towards encouraging commercial economic vitality.
For a clearer edification I have included the language from the resolution
I wrote and was passed on Tuesday:
WHEREAS the property known as Lots 1 and Adjacent 1/3 of Lot 2, Block 65,
Riverdale Park Subdivision on Map 0042, Grid 00C4, Subdivision 1750, Plat
No: A-1017 (hereinafter "Jey’s Auto") is currently vacant with a tenant
unlikely in the foreseeable future.
WHEREAS Jey’s Auto is a cornerstone property on Route 1 and proper
development of such a site is key and critical to the continued economic integrity
and success of that commercial sector in the town of Riverdale Park.
WHEREAS Jey’s Auto has been attempting to lease the property to any
interested third parties.
WHEREAS Jey’s Auto has received numerous code violations that in totality
have yet to be addressed or remedied; thus rendering a lease or purchase by
third parties problematic.
WHEREAS the property (1) has deteriorated to the extent as to constitute a
serious and growing menace public health, safety, and welfare of the
residents of Riverdale Park; (2) is likely to continue to deteriorate; (3) if
allowed to continue deteriorating will contribute to the blighting or
deterioration of the area immediately surrounding it; and (4 the present owner is
unlikely or unable to correct conditions at the property.
WHEREAS the present owners of the property are EDWARD JEYAKODY A REVC
TRUST ETAL & EDWARD SUPRABHA REVC TRUST.
THEREFORE, be it resolved that:
The Town of Riverdale Park shall immediately engage in negotiations to
purchase the property from the listed owners at a fair market value subject to
the approval of the Town Council.
If you have specific concerns regarding why we should not purchase this
property and believe we should leave it vacant, boarded up, and significantly
out of code compliance please let me know. Like you I am concerned about
decisions like these and the impact on my taxes; it is not anticipated
that this will increase or impact the current tax rate. As always, feel free
to reach out to me with any questions or concern.
Best,
Jonathan
