The chain link fence ban by the Town, in practice, is already in effect. Passing an ordinance is just a formality. Fence permits have to be reviewed by the Town Council and they can approve or deny any application and dictate conditions or choice of materials. I submitted an application for a commercial chain link fence and concrete block wall on an existing  loading dock behind the former Leland Hospital building. The fence and wall were completely out of site from any street. The ward 1 council member, Jonathan Ebbeler, did not attend the hearing but submitted a written objection to the proposal that directed the attending Council members and Mayor to table a vote on the fence until he could dictate the conditions that was acceptable to him. Mr. Ebbeler has indicated that he despises chain link in any form and fashion and he doesn’t care where it is or how it is presented. He also informed my client that existing chain link fences are grandfathered and new ones are not allowed.The bottom line is the Council can already selectively ban chain link fences at their discretion and do not need an official ban to dictate their preferences. I imagine pushing for a ban on chain link fences is the Councils attempt to codify by ordinance a practice they have already instituted without a formal ban.
