Appeals of the Planning Board decisions go directly to the Circuit Court (not County Council sitting as the District Council). Appeals of the District Council are filed with the Circuit Court. For the DSP, it was reviewed by the M-U-TC committee that transfers its referral to the Town Council and the Planning Board, the Town Council and Mayor will take vote on a position and transfer that to the Planning Board and District Council. The Planning Board takes a vote (potentially on 5/23), after 30 days the District Council can take up the matter for final say. While I disagree with their vote on a factual level, especially in light of the fact that the County Council just approved a Special Tax District for the property, thus establishing a clear funding mechanism, it is certainly their right to do so.
