Hi Heather

At this time I can only provide a basic sketch of what the process looks like. The applicant has not submitted a Special Permit which will trigger the rest. Additionally the Planning Board itself will set its agenda and public hearings so until there is an application and until the town receives a referral we are in the dark as well.

The process is approximately below:
1). Applicant applies for a special permit
2) Notification of municipalities within seven days
3) Park and Planning staff review of the application
4) Park and planning accepts the application certifying compliance with application instructions and triggering the clock
5) Referrals are made to DPIE (permits and inspection) for comments and recommendations
6) Referrals are made to various departments in Park and Planning (zoning, urban planners etc)
7) Staff comments available to the public at least 7 days prior to the hearing
8) Public hearing by the planning board is scheduled not less than 45 days from the acceptance of the application unless time trigger is waived by the applicant
9) Applicant must notify municipalities and owners of abutting properties of the hearing date at least 14 days prior to the date
9) Planning Board must vote in super majority (4/5) to overturn a denial
10) Planning Board decisions may be appealed to the Circuit Court within 30 days after a decision is made

Thanks for this update, Jonathan.  Can you give us a list of the meetings, public or private, and the timeline that are part of the decision of the Planning Board?  I'm not clear on what the process looks like moving forward, nor on which public or private meetings have bearing on that decision.

The motion to disapprove along with the conditions for the disapproval is attached.  The motion passed unanimously tonight.  There were over 50 design standards deemed out of compliance predicating a disapproval for the application for the 7-11 build-out.
The applicant now has the right to appeal the decision to the planning board via the Special Permit Process.  The Planning Board will have to return a super majority vote in favor of the application to overturn the M-U-TC committee's recommendation of denial.
The Special Permit will also come to Town Council as well as surrounding municipalities of at least University Park, College Park, and Hyattsville.
